In personal injury disputes, the attorney/mediators of IMS serve as a neutral third party to help work through areas of disagreement. In personal injury mediation, there are usually five parties present:

  1. The plaintiff who filed the claim
  2. The plaintiff's attorney
  3. An insurance company claims adjuster
  4. The insurance company's defense attorney
  5. The mediator

The insurance adjuster's presence is important, because he or she decides whether a tendered offer is acceptable.
